These Terms and Conditions govern the photography services provided by Yana Skakun Photography (“the Photographer”), operating at yana-sk-photo.uk, based in Cambridgeshire, England. By booking a session or paying a deposit, you (“the Client”) agree to the terms set out below.
These terms apply to all services including wedding photography, family sessions, portrait sessions, newborn photography, headshots, love story / engagement sessions, and any other photography services offered.
A booking is confirmed only once a written agreement (or email confirmation) and a non-refundable deposit have been received. Until both conditions are met, the date remains available to other clients.
The deposit is 30% of the total package price for weddings and engagement sessions. For portrait, family, newborn, and headshot sessions, full payment is typically required at the time of booking. Specific amounts will be stated in your quote.
The remaining balance is due no later than 4 weeks before the session or wedding date. For bookings made within 4 weeks of the date, full payment is due at the time of booking.
Payment is accepted by bank transfer (BACS). Invoice details are provided on booking. Failure to pay the balance by the due date may result in cancellation of the booking with the deposit forfeited.
Cancellation by the Client
Rescheduling
One complimentary rescheduling is permitted, subject to availability, with a minimum of 3 weeks' notice. Subsequent rescheduling requests or those made with less notice may incur an administration fee of £50.
Cancellation by the Photographer
In the unlikely event that the Photographer must cancel due to illness, injury, or an emergency, every effort will be made to find a suitable replacement photographer. If no replacement can be found, all payments made will be refunded in full. This represents the full extent of the Photographer's liability in this scenario.
Weather
For outdoor sessions affected by severe weather, one complimentary reschedule is offered. The decision to reschedule due to weather rests with the Photographer for safety reasons.
The Client is responsible for arriving at the agreed time and location. If the session starts late due to the Client, the overall session time will be reduced accordingly without any reduction in fee.
The Client is responsible for the safety and behaviour of children or other participants present at the session. The Photographer may pause or end a session if any person behaves in an abusive, threatening, or unsafe manner.
All photographs produced remain the intellectual property of Yana Skakun Photography. Copyright is retained by the Photographer at all times, in accordance with the Copyright, Designs and Patents Act 1988 (UK).
Upon full payment, the Client is granted a non-exclusive, non-transferable personal licence to:
Images may not be sold, licensed, or transferred to any third party, or used for commercial purposes, without prior written consent. A separate commercial licence fee will apply.
The Photographer reserves the right to use images for portfolio, website, social media, competition entries, and promotional purposes. If you prefer your images not to be used publicly, please notify the Photographer in writing before the session. Images will never be sold to third parties.
Edited images are delivered via a private online gallery (high-resolution JPEG). Typical delivery timelines:
Timelines may be longer during peak season (May–October). The online gallery is available for download for 60 days. The Photographer is not obligated to store images beyond this period — the Client is responsible for downloading and backing up their images.
The exact number of delivered images depends on the session length and conditions. Image selection for editing is at the sole discretion of the Photographer.
RAW (unedited) files are not provided under any circumstances. Only fully edited final images will be delivered.
Photography is subject to conditions beyond the Photographer's control (lighting, weather, participant cooperation, venue restrictions). No specific images or outcomes can be guaranteed.
In the event of equipment failure, data loss, or unforeseen circumstances preventing image delivery, the Photographer's liability is limited to a refund of fees paid. The Photographer shall not be liable for indirect, consequential, or special damages.
The Photographer carries public liability insurance. A copy of the certificate is available on request for venue requirements.
Personal data collected during the booking process is used solely to provide and manage your photography services, in accordance with UK GDPR. For full details, see our Privacy Policy.
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
These terms may be updated periodically. The version in force at the time of your booking applies to that booking. The latest version is always available at yana-sk-photo.uk/terms.
